Terms of Service

1. Overview

Kino ("the Service", "we", "us") provides an API relay service that gives developers access to third-party AI video and image generation models through a single HTTPS endpoint. These Terms govern your use of the Service. By creating an account, purchasing credit, or calling the API, you agree to these Terms.

Kino is an independent service and is not affiliated with, endorsed by, or sponsored by ByteDance, Volcano Engine, or any model provider.

2. Accounts & API Tokens

You must keep your credentials confidential. You are responsible for all activity performed with your account and API tokens, including activity by third parties to whom you knowingly or negligently expose them. Tokens can be created, scoped, and revoked at any time from the console.

One account per person or organization. Creating multiple accounts to exploit promotions, commission programs, or abuse protections is prohibited.

3. Billing & Credit

  • Credit is purchased in USD via supported payment providers (cards through our payment processor, or redemption codes).
  • Seedance 2.5 is billed at the published token rate for its input class and actual reported usage. Existing Seedance 2.0/1.5 video models are billed per generated second at the published per-resolution rates. Images are billed per successful image at the published rate. Final usage and billing appear in your task records.
  • Failed generations are not charged. If a task fails or is rejected by the upstream, the full charge is automatically refunded to your balance.
  • Your balance never expires. We do not apply inactivity fees.
  • Except where required by law or where the Service is at fault, prepaid credit is non-refundable once the relevant generation has been consumed. Redemption codes cannot be redeemed for cash.

4. Acceptable Use

Our Acceptable Use Policy forms part of these Terms and applies to every prompt and generation.

You may not use the Service to generate, distribute, or facilitate content that:

  • is illegal under applicable law in your jurisdiction or ours;
  • is NSFW, pornographic, sexually explicit, sexually suggestive, fetish, or erotic;
  • depicts child sexual abuse material (CSAM), sexualizes minors, or contains non-consensual intimate content;
  • constitutes harassment, hate speech, or defamation;
  • impersonates or manipulates real persons without consent, including face swaps and deepfakes;
  • violates third-party intellectual property rights, including generating content that reproduces protected works or brands without authorization;
  • facilitates fraud, deception, or unlawful surveillance;
  • attempts to circumvent our billing, rate limits, or fraud protections (including self-referral schemes to obtain commissions).

Every user-supplied image or video prompt is screened before generation. Flagged and denied prompts are blocked, and generation is also blocked when moderation is unavailable.

We may suspend or terminate accounts that violate this section, withhold or forfeit balances obtained through abuse, and report serious violations to authorities.

5. Third-Party Models & Output

The Service relays requests to third-party model providers. We do not control or warrant the accuracy, safety, or legality of model outputs. You are solely responsible for how you use generated content. Model availability, capabilities, and parameters may change as upstream providers evolve.

6. Availability & SLA

We aim for high availability but do not guarantee uninterrupted or error-free operation. The Service may be suspended for maintenance, upstream outages, or security incidents. Where a generation fails due to our infrastructure, affected credit is refunded in accordance with Section 3.

7. Limitation of Liability

To the maximum extent permitted by law, Kino shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities, arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your account for breach of these Terms, suspected fraud or abuse, or legal/regulatory requirements. Upon termination for breach, remaining balance may be forfeited. Upon termination without cause, we will make reasonable efforts to refund any unused balance.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the console or by email. Continued use after changes take effect constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Singapore.

11. Cloud Studio

Cloud studio uses your existing KinoAPI account, API keys and balance. Editing or saving a canvas does not create a paid generation request. Generation requires your explicit confirmation and remains subject to the existing billing and acceptable-use rules. Cloud content, quotas, retention, deletion and backup limitations are described in the Privacy & Cloud Storage Policy. Only upload and generate content you are authorized to process. Keep independent copies of important work; the initial cloud service and its project revisions are not an off-site backup service. Local GPU processing, local assistants and desktop command execution are not provided by the public cloud studio.
